Terms & Conditions

Estos términos y condiciones se aplican a la aplicación App Fm Radio (en adelante, la "Aplicación") para dispositivos móviles que fue creada por DigitalCity (en adelante, el "Proveedor de Servicios") como un servicio gratuito.

Al descargar o utilizar la Aplicación, usted acepta automáticamente los siguientes términos. Se recomienda encarecidamente que lea y comprenda detenidamente estos términos antes de utilizar la Aplicación. Está estrictamente prohibida la copia o modificación no autorizada de la Aplicación, de cualquier parte de la Aplicación o de nuestras marcas comerciales. No está permitido ningún intento de extraer el código fuente de la Aplicación, traducir la Aplicación a otros idiomas o crear versiones derivadas. Todas las marcas comerciales, derechos de autor, derechos de bases de datos y otros derechos de propiedad intelectual relacionados con la Aplicación siguen siendo propiedad del Proveedor de servicios.

El Proveedor de Servicios se compromete a garantizar que la Aplicación sea lo más eficaz y beneficiosa posible. Por ello, se reserva el derecho de modificar la Aplicación o cobrar por sus servicios en cualquier momento y por cualquier motivo. El Proveedor de Servicios le asegura que cualquier cargo por la Aplicación o sus servicios le será comunicado claramente.

La Aplicación almacena y procesa los datos personales que usted ha proporcionado al Proveedor de Servicios para poder prestar el Servicio. Es su responsabilidad mantener la seguridad de su teléfono y el acceso a la Aplicación. El Proveedor de Servicios recomienda encarecidamente no realizar jailbreaking o rooting en su teléfono, lo que implica eliminar las restricciones y limitaciones de software impuestas por el sistema operativo oficial de su dispositivo. Tales acciones podrían exponer su teléfono a malware, virus, programas maliciosos, comprometer las funciones de seguridad de su teléfono y pueden provocar que la Aplicación no funcione correctamente o que no funcione en absoluto.

Tenga en cuenta que la Aplicación utiliza servicios de terceros que tienen sus propios Términos y Condiciones. A continuación, se incluyen los enlaces a los Términos y Condiciones de los proveedores de servicios externos utilizados por la Aplicación:

Tenga en cuenta que el Proveedor de Servicios no asume la responsabilidad de determinados aspectos. Algunas funciones de la Aplicación requieren una conexión a Internet activa, que puede ser Wi-Fi o proporcionada por su proveedor de red móvil. El Proveedor de Servicios no se hace responsable si la Aplicación no funciona a plena capacidad debido a la falta de acceso a Wi-Fi o si ha agotado su asignación de datos.

Si utiliza la aplicación fuera de un área Wi-Fi, tenga en cuenta que los términos del contrato de su proveedor de red móvil siguen siendo aplicables. En consecuencia, es posible que su proveedor de telefonía móvil le cobre cargos por el uso de datos durante la conexión a la aplicación, o por otros cargos de terceros. Al utilizar la aplicación, usted acepta la responsabilidad de dichos cargos, incluidos los cargos por datos de roaming si utiliza la aplicación fuera de su territorio de origen (es decir, región o país) sin desactivar el roaming de datos. Si no es el pagador de la factura del dispositivo en el que está utilizando la aplicación, se supone que ha obtenido el permiso del pagador de la factura.

De manera similar, el Proveedor de Servicios no siempre puede asumir la responsabilidad por el uso que usted haga de la aplicación. Por ejemplo, es su responsabilidad asegurarse de que su dispositivo se mantenga cargado. Si su dispositivo se queda sin batería y usted no puede acceder al Servicio, el Proveedor de Servicios no se hace responsable.

En cuanto a la responsabilidad del Proveedor de Servicios por el uso que usted haga de la aplicación, es importante tener en cuenta que, si bien se esfuerzan por garantizar que la misma esté actualizada y sea precisa en todo momento, dependen de terceros para que les proporcionen información para que puedan ponerla a su disposición. El Proveedor de Servicios no acepta ninguna responsabilidad por cualquier pérdida, directa o indirecta, que usted experimente como resultado de confiar completamente en esta funcionalidad de la aplicación.

Es posible que el Proveedor de Servicios desee actualizar la aplicación en algún momento. La aplicación está disponible actualmente según los requisitos del sistema operativo (y de cualquier sistema adicional al que decidan ampliar la disponibilidad de la aplicación) que pueden cambiar, y usted deberá descargar las actualizaciones si desea continuar usando la aplicación. El Proveedor de Servicios no garantiza que siempre actualizará la aplicación para que sea relevante para usted y/o compatible con la versión particular del sistema operativo instalado en su dispositivo. Sin embargo, usted acepta siempre aceptar las actualizaciones de la aplicación cuando se le ofrezcan. El Proveedor de Servicios también puede desear dejar de proporcionar la aplicación y puede terminar su uso en cualquier momento sin notificarle la terminación. A menos que le informen lo contrario, en caso de terminación, (a) los derechos y licencias otorgados a usted en estos términos finalizarán; (b) usted debe dejar de usar la aplicación y (si es necesario) eliminarla de su dispositivo.

El Proveedor de Servicios puede actualizar periódicamente sus Términos y Condiciones. Por lo tanto, se recomienda revisar esta página periódicamente para comprobar si se han producido cambios. El Proveedor de Servicios le notificará cualquier cambio publicando los nuevos Términos y Condiciones en esta página.

These terms and conditions apply to the App Fm Radio (hereby referred to as "Application") for mobile devices that was created by DigitalCity (hereby referred to as "Service Provider") as a Free service.

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.

The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advise against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.

Please note that the Application utilizes third-party services that have their own Terms and Conditions. Below are the links to the Terms and Conditions of the third-party service providers used by the Application:

Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.

If you are using the application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges. By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the application, they assume that you have obtained permission from the bill payer.

Similarly, the Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.

In terms of the Service Provider's responsibility for your use of the application, it is important to note that while they strive to ensure that it is updated and accurate at all times, they do rely on third parties to provide information to them so that they can make it available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the application.

The Service Provider may wish to update the application at some point. The application is currently available as per the requirements for the operating system (and for any additional systems they decide to extend the availability of the application to) may change, and you will need to download the updates if you want to continue using the application. The Service Provider does not guarantee that it will always update the application so that it is relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the application when offered to you. The Service Provider may also wish to cease providing the application and may terminate its use at any time without providing termination notice to you. Unless they inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the application, and (if necessary) delete it from your device.

The Service Provider may periodically update their Terms and Conditions. Therefore, you are advised to review this page regularly for any changes. The Service Provider will notify you of any changes by posting the new Terms and Conditions on this page.
